1. Agreement to these terms

These Terms & Conditions apply to your use of the KetoTrainer website, assessment, program materials and related services. By using the service or purchasing a KetoTrainer program, you agree to these Terms together with the Privacy Policy, Refunds & Cancellations Policy and Health & Safety Information.

2. About KetoTrainer

KetoTrainer is a structured, self-guided nutrition and lifestyle program. It is not a medical service, medical diagnosis, emergency service or substitute for individual medical care.

KetoTrainer’s proprietary classifications are program-routing categories. They are not medical diagnoses and do not establish whether you have a medical condition.

3. Eligibility and assessment

• KetoTrainer’s current self-guided programs are designed for adults aged 18 or over.
• You must provide assessment information accurately to the best of your knowledge.
• Health conditions, medications, dietary requirements or other safety factors may mean KetoTrainer cannot recommend a program.
• A program is offered only after the assessment and applicable safety checks. Customers do not freely self-select a KetoTrainer classification or diet before assessment.
• If relevant health or medication information changes, you should complete the required reassessment or safety process before relying on the prior recommendation.

4. Program structure

Your assessment may recommend a Keto or Non-Keto starting program and a pathway containing one, two, three or four 12-week stages, depending on suitability and the program rules.

At the end of a stage, a Progress Check may recommend that you repeat the current stage, progress to the next recommended stage, or complete your recommended Journey. Progression is not automatic or guaranteed.

Where a repeat of the current stage is recommended, another 12-week period in that stage is provided at no additional program charge and does not consume a prepaid future-stage entitlement.

5. Purchases and payment

Consumer prices displayed by KetoTrainer are in Australian dollars and include GST unless expressly stated otherwise. KetoTrainer programs are one-time purchases, not subscriptions, and do not automatically renew.

Where payment is processed by a third-party payment provider such as Stripe, its technical payment-processing terms may also apply. KetoTrainer does not intend to store complete payment-card details.

If a Full Journey purchase is available to you, prepayment does not guarantee progression or the timing of any future-stage unlock. Only the current eligible stage is made available initially.

6. Program materials and licence

Unless otherwise stated, KetoTrainer grants you a personal, limited, non-exclusive, non-transferable right to use your unlocked program materials for your own personal use.

You must not reproduce, sell, redistribute, publish, sublicense, scrape or commercially exploit KetoTrainer program materials without written permission, except where Australian law gives you a right that cannot be excluded.

7. Your responsibilities

• Use the program only in a manner appropriate to your circumstances and the safety information provided.
• Do not change prescribed medicines, doses or treatment because of KetoTrainer content.
• Seek appropriate professional healthcare advice where needed.
• Keep account credentials secure and tell us promptly if you suspect unauthorised account access.
• Do not misuse, interfere with, probe or attempt unauthorised access to the website or service.

8. No guaranteed outcome

Individual results vary. KetoTrainer does not guarantee a particular amount of weight change, health result, symptom improvement, classification change or progression between stages.

9. Availability and changes

We may maintain, update, secure or modify the website and service from time to time. We may suspend access where reasonably necessary for security, maintenance, legal compliance or to protect users. We will not use these Terms to remove rights that cannot legally be excluded.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. See our Refunds & Cancellations Policy for more information about remedies and change-of-mind requests.

11. Liability

To the maximum extent permitted by law, KetoTrainer is not responsible for losses that are not caused by our breach of law or these Terms, or that were not reasonably foreseeable. Nothing in this section limits liability that cannot legally be limited or excluded.

12. Privacy

Our handling of personal and health information is described in the Privacy Policy. Sensitive assessment information is subject to a separate consent process before collection.

13. Governing law

These Terms are governed by the laws applying in Victoria, Australia, and applicable Commonwealth laws. Any mandatory consumer rights that apply in another Australian jurisdiction are not excluded.
